Introduction

ecocentra or http:/www.ecocentra.com is a Website that brings together products and Services that take into account ecological and human rights consequences. It hopes to make ethical consumerism easy and valuable by bringing together a variety of goods in one, easy to search, place. By providing free listing of auction items ecocentra provides an economically competitive channel to springboard eco friendly businesses. Ecocentra do not charge a commission when an item is sold. The site is divided into different categories. While not all products will satisfy all criteria but they should benefit at least one area of ethical consumerism and be easily searchable based on those criteria.

Ecocentra relies on sellers to establish their ethical standpoint and to ensure that products meet the requirement. Through a feedback system a seller can build on his/ her ecological and Service reputation. On this basis it is important for Users to use the feedback system but also to report Services that are not in the spirit of ethical consumerism. To become a User of the site you must first read, agree with and accept all of the Terms and Conditions contained in this agreement, set out below, as set out by econcentra (“us”, “we”) operating from the URL http:/www.ecocentra.com. We strongly recommend that you read these Terms and Conditions.

The Terms and Conditions may be amended by ecocentra at anytime by posting revised notices on the Website. The “User” refers to any registered Users of our Website. As a user you have 30 days to operate under the rules of the expired terms and condition before accepting changes to the Terms and Conditions. No other amendments to this User Agreement will be effective.

1. These Terms and Conditions govern the legal relationship between ecocentra (“we” or “us”) and registered Users of our Website (“Users”).

2. Defined terms as used in these Terms and Conditions

2.1. “Website” means ecocentra’s auction and market Website operating from the URL of http://www.ecocentra.com.

2.2. “Services” means any products or Services offered for sale, auction or advertisement on the Website.

2.3. “Ethical Spirit” is the conduct of the User with respect to ethical and/or ecological consumer practices.

2.4. “Parties” is the collective term for the Buyer and seller in a transaction.

2.5. “Buyer” is that part of the parties that makes a purchase on the Website

2.6. “Seller” is that part of the parties that makes a sale on the Website

2.7. “Basic Package” is an entry level advertising post available to all Users.

2.8. “Upgraded Package” is an advertising post that offers extra tools such as, but not limited to, fees for sponsored links, fees for bold ads, fees for personalised member sub-sites within ecocentra.

2.9. “Pay It Now” items are Services that are on offer on a direct sale basis without the process of an auction in place.

2.10. “Ad” is the posting of a sale Ad on the Website.

3. To gain membership of ecocentra the User must be 16 years or over and ecocentra reserves the right to refuse or remove membership to any Users who do not abide by the Terms and Conditions or are operating outside of the Ethical Spirit of ecocentra.

4. By signing up for membership you are agreeing to abide by the Terms and Conditions as set out here.

5. To post a Service on the Website the Service must be deemed to be within the Ethical Spirit of ecocentra. This means that the Service should take into account at a significant aspect of ecological and human rights consequences. Ecocentra reserves the right to refuse or remove Services without notice, or providing a reason, of any products not deemed to be of the Ethical Spirit of ecocentra.

6. Under the fee structure of ecocentra Users are able to buy and sell Services on this Website under the fees set out in the fee section of the site. Ecocentra reserves the right change fee structures and a 30-day notice period will be in effect for changes to the fee structures. Ecocentra reserves the right to do this at any time by posting revised Terms and Conditions on the Website.

7. Users may terminate membership of ecocentra at any time by emailing ecocentra. The contact details are given below. Termination of membership will cause the closure of all Services listed on ecocentra.

8. Ecocentra offers no guarantees on the availability of the Website and reserves the right remove the Website and close all activity on the Website for any reason.

9. We reserve the right to contact Users with changes to the Website or to inform of matters of potential interest to customers.

10. Sellers Responsibilities require the seller to ensure his/ her able position to offer the Services as stated in their Ad. Failure of the seller to carry out the transaction is the responsibility of the seller. Ecocentra is a Website that acts as a location for others to trade. Ecocentra is not responsible for the conduct of the seller and the nature of the sale. Ecocentra will do it’s best to help resolve any problems but is in no way liable or responsible for any transactions on the Website. Ecocentra furthermore reserves the right to terminate a User account without warning or reason.

11. Buyers Responsibilities require the Buyer to ensure his/ her able position to acquire the Service as stated in the Seller’s Ad. Failure of the Buyer to carry out the transaction is the responsibility of the Buyer. Ecocentra is a Website that acts as location for others to trade. Ecocentra is not responsible for the conduct of the Buyer and the nature of the sale. Ecocentra will do it’s best to help resolve any problems but is in no way liable or responsible for any transactions on the Website. Ecocentra furthermore reserves the rights to terminate a User account without warning or reason.

12. Personal Data

12.1. Ecocentra will not transfer personal information to third parties unless authorised by the User to do so.

12.2. Ecocentra stores personal information but does not guarantee the safety of personal information in the event of data theft arising from unauthorised methods of site security access.

12.3. Ecocentra may use the Website usage and personal data for in-house statistics and forecasting.

13. Sale Contracts

13.1. Standard Auctions

13.1.1. The Seller must accept the highest bid if it exceeds the reserve price, or in the case of no reserve price having been set, the seller must accept the highest bid at the time of auctions closure.

13.1.2. The Buyer is obliged to fulfil his/ her purchase if it exceeds the reserve price, or in the case of no reserve price having been set, if the Buyers bid is the highest bid at the time of auction closure.

13.2. Pay It Now items

13.2.3. The Seller must accept Pay It Now payment as set out in the Ad.

13.2.4. The Seller must be able to supply funds under the Pay It Now payment as set out in the Ad.

13.3. Ecocentra has no obligation to Users in ensuring or enforcing the Sales Contract. It is entirely the responsibility of the Buyer and seller to meet the conditions of the Sale Contract. Ecocentra shall not be liable for any loss arising out of Sale Contracts when parties fail to meet the obligations towards each other. Ecocentra will however help if, and where, it can to provide information and guidance.

14. Banned Services are Services that should not be sold or advertised on ecocentra’s Website. These items include, but are not limited to, pornographic materials, weapons, materials that could be used to make weapons, chemicals of a hazardous nature. Ecocentra reserves the right to remove without warning or providing reason any Services we deem to part of Banned Services.

15. Membership to this web-site is only available to those who can form a legally binding contract. This web-site does not permit minors (under 16) to register. If any member fails to signup with their correct age the account will be terminated immediately.
